If you have an outstanding warrant in Florida and get arrested in another state, you could face extradition back to Florida. This process can be frustrating, time-consuming, and legally complex.

How Extradition Works

Here in Fort Lauderdale, I see this situation often—especially with travelers coming in and out on cruise ships. Many people don’t even realize they have a warrant until they get arrested while boarding or disembarking. Once in custody, they are taken to Broward County Jail and can sit there for up to 30 days while waiting for another state to act on the warrant.

Similarly, if you have a Florida warrant and get arrested in another state—say, New York—you could be held for 30 days while Florida authorities decide whether to bring you back.

What Happens If Florida Doesn’t Extradite You?

If Florida fails to extradite you within 30 days, you may be released. However, that doesn’t mean the warrant disappears. The next time you’re stopped by law enforcement, you could face arrest all over again.

How to Handle an Out-of-State Warrant

If you have an active warrant in Florida, it’s best to take action before you get arrested. You may be able to:

  • Resolve the case remotely with legal representation
  • Avoid unnecessary jail time by addressing the warrant proactively
  • Negotiate surrender terms that minimize disruption to your life
