What are the alternative sentencing options for DUI offenders in Florida?

 

 

What I’m holding here is something called a criminal punishment scoresheet. This is used in Florida to determine someone’s sentence. It starts with the primary offense that the client is accused of committing, any additional offenses, and then there are a whole host of factors that go into determining the minimum allowable sentence, such as whether someone died or whether it involved any sex acts. Then you have to address any prior convictions this person had. Then we have the total sentence points. There’s a formula and that gives you the minimum allowable sentence that the judge will give, unless a defense lawyer files something called a motion for downward departure. That is one of the several factors that a judge could consider to deviate from that minimum sentence.
