What types of factors influence sentencing decisions in Florida criminal cases?
A client was asking me what sort of alternative sentencing options were available to him. He’s charged with a DUI. I explained to him that there is little wiggle room for judges when sentencing for a DUI. The sentence will be a minimum six month driver’s license suspension and a minimum of six months on probation, plus some other factors. The best way to get alternate sentencing options is to hire a good criminal defense lawyer who’s going to look into the case and hopefully poke enough holes into it that the state changes the charge to reckless driving. With reckless driving, there’s a lot more wiggle room for sentencing.
